CatBreedr Terms of Service

1. Acceptance

By using CatBreedr you agree to these Terms. If you do not agree, do not use the app. Welcome to CatBreedr. These Terms of Service ("Terms") govern your use of the CatBreedr application, website, and related services (collectively, the "Service"). By creating an account, accessing, or using CatBreedr, you agree to these Terms. If you do not agree with these Terms, you may not use the Service.

2. Guest use

You may use CatBreedr without creating an account. Guest data is stored on your device and may be lost if the app is uninstalled or device storage is cleared.

3. Acceptable use

You agree not to misuse the app, harass others, post unlawful content, or attempt to disrupt services. Cat breeding and meetups are your responsibility; follow local laws and animal-welfare standards.

4. No professional advice

Heat-cycle tracking and search tools are informational only and are not veterinary or legal advice.

5. Maps & location

Map and distance features depend on device GPS and third-party map data. Accuracy is not guaranteed.

6. Disclaimer

The app is provided "as is" without warranties of any kind. To the maximum extent allowed by law, the developers are not liable for damages arising from use of the app.

7. Changes

These Terms may be updated. Continued use after changes means you accept the updated Terms.

8. About CatBreedr

CatBreedr is an online platform intended to help users discover, communicate with, and potentially connect with other individuals regarding cat breeding and related activities. CatBreedr is a platform and communication service only. CatBreedr does not act as a breeder, broker, veterinarian, animal-care provider, trainer, agent, representative, or intermediary for users. CatBreedr does not guarantee that any user, cat, breeder, owner, listing, profile, statement, photograph, pedigree, health claim, breeding claim, or other information provided through the Service is accurate, complete, legitimate, or trustworthy. Users are solely responsible for conducting their own research and determining whether another user, cat, breeding arrangement, transaction, or meeting is appropriate.

9. Eligibility

You must be legally permitted to use the Service in your jurisdiction. By using CatBreedr, you represent that: - You have the legal capacity to enter into these Terms. - The information you provide is accurate to the best of your knowledge. - You will comply with all applicable federal, state, local, and international laws and regulations. - You will comply with applicable animal-welfare, breeding, licensing, ownership, and veterinary requirements. CatBreedr may restrict or terminate accounts that violate these Terms or applicable law.

10. User Accounts

You may be required to create an account to access certain features. You are responsible for: - Maintaining the confidentiality of your account credentials. - Providing accurate information. - Keeping your account information current. - All activity occurring through your account. - Immediately notifying CatBreedr if you believe your account has been compromised. You may not impersonate another person or create an account using false or misleading information.

11. User-Generated Content

Users may submit profiles, photographs, messages, advertisements, listings, descriptions, comments, and other content ("User Content"). You are solely responsible for the User Content you submit. You agree not to post or send content that: - Is fraudulent, deceptive, or materially misleading. - Violates another person's rights. - Is unlawful or promotes unlawful activity. - Contains threats, harassment, or abuse. - Contains malicious software. - Infringes copyrights, trademarks, or other intellectual-property rights. - Promotes animal cruelty or illegal animal activity. - Contains inappropriate or prohibited content. - Attempts to scam, defraud, or otherwise harm another user. CatBreedr reserves the right, but does not necessarily have the obligation, to remove User Content or restrict accounts that violate these Terms.

12. Communications Between Users

CatBreedr may provide messaging and communication features that allow users to communicate directly with one another. CatBreedr is not responsible for messages, statements, representations, promises, agreements, arrangements, advice, or other communications made between users. Any communication between users occurs directly between those users. CatBreedr does not guarantee the accuracy, honesty, legality, safety, or reliability of communications made by users. Users should independently verify information received from other users before relying upon it.

13. Meetings and Interactions Between Users

Users may choose to meet, communicate with, exchange animals, arrange breeding activities, conduct transactions, or otherwise interact with one another outside the Service. CatBreedr is not responsible for anything that happens during or as a result of meetings or interactions between users. This includes, without limitation: - Personal injuries. - Property damage. - Theft or loss. - Assault, harassment, or other misconduct. - Animal injuries, illness, death, escape, or loss. - Disagreements or disputes. - Breeding outcomes. - Pregnancy or reproductive complications. - Veterinary expenses. - Financial losses. - Transportation incidents. - Fraud or misrepresentation. - Criminal conduct. - Any other harm, loss, damage, or injury. You are solely responsible for deciding whether, when, where, and how to meet another user. CatBreedr strongly encourages users to exercise appropriate caution and use reasonable safety measures when interacting with people or animals they meet through the Service.

14. Breeding Arrangements

CatBreedr does not guarantee the outcome of any breeding arrangement. Users are solely responsible for determining: - Whether cats are appropriate for breeding. - Whether health testing should be performed. - Whether veterinary consultation is appropriate. - Whether breeding is legal in the applicable jurisdiction. - Ownership and breeding rights. - Stud fees, deposits, payments, or other financial arrangements. - Contracts between users. - Care of animals before, during, and after breeding. - Any resulting kittens or offspring. CatBreedr is not responsible for reproductive outcomes, veterinary complications, genetic conditions, birth complications, kitten health, or disputes relating to breeding arrangements. Users should consult a qualified veterinarian and, where appropriate, a qualified attorney before entering into breeding arrangements.

15. Transactions and Payments Between Users

Unless expressly stated otherwise, CatBreedr is not a party to agreements or transactions between users. If users exchange money, animals, services, deposits, fees, or other consideration, the transaction is between those users. CatBreedr does not guarantee that a user will pay, receive payment, provide an animal, provide a service, or honor an agreement. CatBreedr is not responsible for losses resulting from transactions between users. Users are responsible for complying with all applicable laws concerning the sale, transfer, ownership, transportation, and breeding of animals.

16. No Professional Advice

Information available through CatBreedr is provided for general informational purposes only. CatBreedr does not provide veterinary, legal, financial, breeding, genetic, or other professional advice. You should consult an appropriately qualified professional for advice concerning your specific situation.

17. Third-Party Information

Profiles, listings, photographs, messages, advertisements, and other information supplied by users or third parties may be inaccurate or misleading. CatBreedr does not endorse or guarantee any user, breeder, cat, claim, listing, product, service, or recommendation available through the Service. You use information provided by other users at your own risk.

18. Assumption of Risk

To the maximum extent permitted by law, you voluntarily assume the risks associated with communicating and interacting with other users through CatBreedr. You acknowledge that CatBreedr cannot control the conduct of its users and cannot guarantee your safety or the safety of any animal involved in an interaction.

19. Release of CatBreedr

To the maximum extent permitted by applicable law, you release and hold harmless CatBreedr and its owners, operators, employees, contractors, affiliates, officers, directors, and agents from claims, demands, damages, losses, liabilities, costs, and expenses arising from or related to: - Your interactions with other users. - Messages or communications between users. - Meetings between users. - Transactions between users. - Breeding arrangements. - Conduct of users. - Animals encountered through the Service. - Injuries, death, or property damage. - Disputes between users. - User-generated content. - Information supplied by users. - Your use or misuse of the Service. This provision does not apply to the extent prohibited by applicable law.

20. Limitation of Liability

To the maximum extent permitted by law, CatBreedr and its owners, operators, employees, contractors, affiliates, officers, directors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Service or interactions with other users. To the maximum extent permitted by law, CatBreedr's total liability for claims arising out of or relating to the Service will be limited to the greater of: 1. The amount you paid CatBreedr for use of the Service during the twelve months preceding the event giving rise to the claim; or 2. $100. Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited under applicable law.

21. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless CatBreedr and its owners, operators, employees, contractors, affiliates, officers, directors, and agents from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to: - Your use of the Service. - Your User Content. - Your violation of these Terms. - Your violation of applicable law. - Your interaction with another user. - Any meeting or transaction between you and another user. - Any breeding arrangement you enter into. - Your conduct toward another person or animal.

22. Prohibited Conduct

You may not use CatBreedr to: - Commit fraud or deception. - Harass, threaten, stalk, or abuse another person. - Facilitate illegal animal activity. - Promote animal cruelty. - Circumvent applicable breeding or animal-ownership laws. - Distribute malware or malicious code. - Attempt to gain unauthorized access to another account. - Collect or misuse another user's personal information. - Use the Service for unlawful purposes. - Interfere with the operation or security of the Service.

23. Reporting Users

If you believe another user has violated these Terms, engaged in fraudulent behavior, threatened someone, or otherwise created a safety concern, you may report that user through available CatBreedr reporting features. CatBreedr may investigate reports and may take actions including removing content, restricting communication, suspending accounts, or terminating accounts. However, CatBreedr does not guarantee that it will investigate every report or take any particular action.

24. Account Suspension and Termination

CatBreedr may suspend or terminate your account at any time if it believes you have violated these Terms, applicable law, or created a risk to the Service or other users. You may stop using the Service at any time. Sections concerning liability, indemnification, disputes, intellectual property, and other provisions that by their nature should survive termination will survive termination.

25. Intellectual Property

The CatBreedr name, logo, software, design, graphics, features, and other original materials associated with the Service are owned by CatBreedr or its licensors and may be protected by applicable intellectual-property laws. You may not copy, modify, distribute, sell, reverse engineer, or exploit the Service except as permitted by law or with written permission.

26. Privacy

Your use of CatBreedr is also governed by the CatBreedr Privacy Policy. By using the Service, you acknowledge that information may be collected, used, stored, and disclosed as described in the Privacy Policy.

27. Changes to These Terms

CatBreedr may modify these Terms from time to time. Updated Terms will be posted through the Service with an updated effective date. Your continued use of CatBreedr after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

28. Governing Law

These Terms will be governed by the laws applicable in the jurisdiction designated by CatBreedr, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any legal action or proceeding arising out of or relating to these Terms or the Service will be brought in a court of competent jurisdiction located in the State of Delaware, except where applicable law requires otherwise.

29. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.

30. Entire Agreement

These Terms and the CatBreedr Privacy Policy constitute the agreement between you and CatBreedr regarding your use of the Service, unless additional terms expressly apply to a particular feature.

Community Standards and child safety

Do not share illegal, abusive, hateful, harassing, sexually exploitative, deceptive, impersonating, animal-abuse or privacy-invading material. Child sexual abuse and exploitation, including child sexual abuse material (CSAM), grooming and trafficking, are expressly prohibited. Report unsafe users or content from their profile, messages or reviews. Block users to restrict interactions. We review reports and may remove content, restrict features or impose temporary or permanent account/device bans. For child-safety reports contact contactus@breedrs.app; report imminent danger to local authorities. Confirmed illegal child-safety material will be handled under applicable reporting obligations. You must accept these Terms and Community Standards before posting, messaging or uploading. Only share material you have rights and permission to share.
